End-User Agreement
Overview:
Welcome to U.S. WEED CHANNEL! We are a free and subscription service that provides our members with access to motion pictures, television and other audio-visual entertainment ("U.S. WEED CHANNEL content") streamed over the Internet to certain Internet-connected TV's, computers and other devices ("U.S. WEED CHANNEL ready devices").
You have accepted these Terms of Use, which govern your use of our service. As used in these Terms of Use, "U.S. WEED CHANNEL service," "our service" or "the service" means the service provided by U.S. WEED CHANNEL for discovering and watching U.S. WEED CHANNEL content, including all features and functionalities, website, and user interfaces, as well as all content and software associated with our service.
You agree to the Dispute Agreement and class action waiver described in Section 15 to resolve any disputes with U.S. WEED CHANNEL.
Please note that these Terms of Use include hyperlinks that may be accessed only through our website, so if you are reviewing these Terms of Use through certain U.S. WEED CHANNEL ready devices, you may need to review these hyperlinked terms.
Acceptance of Terms of Use
These Terms of Use, which include our Privacy Statement and End User License Agreement ("EULA") govern your use of the U.S. WEED CHANNEL service. By using, visiting, or browsing the U.S. WEED CHANNEL service, you accept and agree to these Terms of Use. If you do not agree to these Terms of Use, do not use the U.S. WEED CHANNEL service.
The U.S. WEED CHANNEL service is provided by USWC Media, LLC., or one of its affiliated companies. Check back as the service provider may change from time to time.
Changes to Terms of Use. U.S. WEED CHANNEL may, from time to time, change these Terms of Use, including the Privacy Statement and EULA. Such revisions shall be effective immediately; provided however, for existing members, such revisions shall, unless otherwise stated, be effective 30 days after posting.
Privacy.
Personally identifying information is subject to our Privacy Statement, the terms of which are incorporated herein. Please review our Privacy Statement to understand our practices.
Communication Preferences. By using the U.S. WEED CHANNEL service, you consent to receiving electronic communications from U.S. WEED CHANNEL relating to your account. These communications may involve sending emails to your email address provided during registration, or posting communications on the U.S. WEED CHANNEL service, or in the "Your Account" page and will include notices about your account (e.g., payment authorizations, change in password or Payment Method, confirmation e-mails and other transactional information) and are part of your relationship with U.S. WEED CHANNEL. You agree that any notices, agreements, disclosures or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing. You should maintain copies of electronic communications by printing a paper copy or saving an electronic copy. You also consent to receiving certain other communications from us, such as newsletters about new U.S. WEED CHANNEL features and content, special offers, promotional announcements and customer surveys via email or other methods. If you no longer want to receive certain non-transactional communications, you will have the option to stop U.S. WEED CHANNEL communications. Please review our Privacy Statement (www.USWEED CHANNEL.com/Privacy) for further detail on our marketing communications.
Membership, Free Trials, Billing and Cancellation
Membership
Ongoing Membership. Your U.S. WEED CHANNEL membership, which may start with a free trial, will continue month-to-month or year-to-year and automatically renew unless and until you cancel your membership or we terminate it. You must have Internet access and provide us with a current, valid, accepted method of payment (as such may be updated from time to time, "Payment Method") to use the U.S. WEED CHANNEL service. We will bill the membership fee you selected to your Payment Method. You must cancel your membership before it renews in order to avoid billing of the next month's membership fees to your Payment Method.
Differing Memberships.
We may offer a number of membership plans, including special promotional plans or memberships with differing conditions and limitations. Any materially different terms from those described in these Terms of Use will be disclosed at your sign-up or in other communications made available to you. You can find specific details regarding your membership with U.S. WEED CHANNEL by visiting our website and clicking on the "Your Account" link. Some promotional memberships are offered by third parties in conjunction with the provision of their own products and services. We are not responsible for the products and services provided by such third parties. We reserve the right to modify, terminate or otherwise amend our offered membership plans.
Free Trials
Your U.S. WEED CHANNEL membership may start with a free trial. The free trial period of your membership lasts for one week, or as otherwise specified during sign-up. For combinations with other offers, restrictions may apply. Free trials are for new and certain former members only. U.S. WEED CHANNEL reserves the right, in its absolute discretion, to determine your free trial eligibility.
We will begin billing your Payment Method for membership fees at the start or end of the free trial period of your membership and your membership will automatically renew unless you cancel prior to the end of the free trial period. We may authorize your Payment Method through various methods, including authorizing it up to approximately one month of service as soon as you register. In some instances, your available balance or credit limit may be reduced to reflect the authorization during your free trial period.
CLICK THE "YOUR ACCOUNT" LINK AT THE TOP OF ANY U.S. WEED CHANNEL WEB PAGE (www.watch.USWEEDCHANNEL.com) TO FIND CANCELLATION INSTRUCTIONS. We will continue to bill your Payment Method on your selected basis for your membership fee until you cancel.
Billing
Recurring Billing.
By starting your U.S. WEED CHANNEL membership and providing or designating a Payment Method, you authorize us to charge you a membership fee at the then current rate, and any other charges you may incur in connection with your use of the U.S. WEED CHANNEL service, such as taxes or possible transaction fees, to your Payment Method. You acknowledge that the amount billed may vary for reasons that may include differing amounts due to promotional offers, including gift card redemption and promotional code redemption, and/or changing or adding a plan, and you authorize us to charge your Payment Method for such varying amounts, which may be billed in one or more charges.
Price Changes. We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms of Use, any price changes to your service will take effect following email notice to you.
Billing Cycle.
The membership fee for our service will be billed at the beginning of your membership and each month or year thereafter unless and until you cancel your membership. We automatically bill your Payment Method on the calendar day corresponding to the commencement of your paying membership. Membership fees are fully earned upon payment. We reserve the right to change the timing of our billing, in particular, as indicated below, if your Payment Method has not successfully settled. In the event your paying membership began on a day not contained in a given month, we may bill your Payment Method on a day in the applicable month or such other day as we deem appropriate. For example, if you started your U.S. WEED CHANNEL membership or became a paying member on January 31st, your next payment date is likely to be February 28th, and your Payment Method would be billed on that date. Your renewal date may change due to changes in your Membership. We may authorize your Payment Method in anticipation of membership or service-related charges. As used in these Terms of Use, "billing" shall indicate a charge, debit or other payment clearance, as applicable, against your Payment Method. Unless otherwise stated differently, month or monthly refers to your billing cycle.
No Refunds.
PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members ("credits"). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.
Payment Methods.
You may edit your Payment Method information by visiting our website and clicking on the "Your Account" link, available at the top of the pages of the U.S. WEED CHANNEL website. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information or cancel your account (see, "Cancellation" below), you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing dates. We may update your Payment Method with information provided by the applicable payment service provider, and you authorize us to continue to charge the membership fee to the updated Payment Method. For certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or other charges. Check with your Payment Method service provider for details.
Cancellation.
You may cancel your U.S. WEED CHANNEL membership at any time, and you will continue to have access to the U.S. WEED CHANNEL service through the end of your monthly billing period. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL MEMBERSHIP PERIODS OR UNWATCHED U.S. WEED CHANNEL CONTENT. To cancel, go to the "Your Account" page on our website and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. To see when your account will close, click "View billing details" on the "Your Account" page. If you signed up for U.S. WEED CHANNEL using your account with a third party as a Payment Method, and wish to cancel your U.S. WEED CHANNEL membership at any time, including during your free trial, you may need to do so through such third party, including by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from, the U.S. WEED CHANNEL service through that third party. You may also find billing information about your U.S. WEED CHANNEL membership by visiting your account with the applicable third party.
The U.S. WEED CHANNEL Service
You agree and understand that Using, Sharing, or Participating in the U.S. WEED CHANNEL Service in any way is legal in your Country, State, Province, and Territory, and that full legal responsibility for your use of the U.S. WEED CHANNEL Service in any way is yours. Further, that any loss or culpability arising from your use of the U.S WEED CHANNEL Service is your responsibility in full.
You must be 18 years of age, or the age of majority in your province, territory or country, to become a member of the U.S. WEED CHANNEL service. Individuals under the age of 18, or applicable age of majority, may utilize the service only with the involvement of a parent or legal guardian, under such person's account and otherwise subject to these Terms of Use.
The U.S. WEED CHANNEL service and any content viewed through our service are for your personal and non-commercial use only. During your U.S. WEED CHANNEL membership, we grant you a limited, non-exclusive, non-transferable, license to access the U.S. WEED CHANNEL service and view U.S. WEED CHANNEL content through the service. Except for the foregoing limited license, no right, title or interest shall be transferred to you. You agree not to use the service for public performances. You agree to know and obey applicable laws in your province, territory or country and not to use the service where not permitted by law.
You may view U.S. WEED CHANNEL content through the U.S. WEED CHANNEL service primarily within the country in which you have established your account and only in geographic locations where we offer our service and have licensed such U.S. WEED CHANNEL content. The content that may be available to watch will vary by geographic location. U.S. WEED CHANNEL will use technologies to verify your geographic location. THE NUMBER OF DEVICES ON WHICH YOU MAY SIMULTANEOUSLY WATCH IS LIMITED. Go to the change plan information in the "Your Account" page to see the number of devices on which you may simultaneously watch. The number of devices available for use and the simultaneous streams may change from time to time at our discretion.
We continually update the U.S. WEED CHANNEL service, including the content library. In addition, we continually test various aspects of our service, including our website, user interfaces, service levels, plans, promotional features, availability of U.S. WEED CHANNEL content, delivery and pricing. We reserve the right to, and by using our service you agree that we may, include you in or exclude you from these tests without notice. We reserve the right in our sole and absolute discretion to make changes from time to time and without notice in how we offer and operate our service.
Some U.S. WEED CHANNEL content is available for temporary download and offline viewing on certain supported devices (“Offline Titles”). Limitations apply, including restrictions on the number of Offline Titles per account, the maximum number of devices that can contain Offline Titles, the time period within which you will need to begin viewing Offline Titles and how long the Offline Titles will remain accessible. Some Offline Titles may not be playable in certain countries and if you go online in a country where you would not be able to stream that Offline Title, the Offline Title will not be playable while you are in that country.
You agree to use the U.S. WEED CHANNEL service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. Except as explicitly authorized in these Terms of Use, you agree not to archive, download (other than through caching necessary for personal use), reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use content and information contained on or obtained from or through the U.S. WEED CHANNEL service without express written permission from U.S. WEED CHANNEL and its licensors. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the U.S. WEED CHANNEL service; use any robot, spider, scraper or other automated means to access the U.S. WEED CHANNEL service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the U.S. WEED CHANNEL service; insert any code or product or manipulate the content of the U.S. WEED CHANNEL service in any way; or, use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the U.S. WEED CHANNEL service, including any software viruses or any other computer code, files or programs.
The availability of U.S. WEED CHANNEL content to watch will change from time to time, and from country to country. The quality of the display of the U.S. WEED CHANNEL content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. HD, Ultra HD and HDR availability is subject to your Internet service and device capabilities. Not all content is available in all formats, such as HD, Ultra HD or HDR and not all plans allow you to receive content in all formats. Default playback settings on cellular networks exclude HD, Ultra HD and HDR content. The minimum connection speed for SD quality is 0.5 Mbps; however, we recommend a faster connection for improved video quality. A download speed of at least 5.0 Mbps per stream is recommended to receive HD content (defined as a resolution of 720p or higher). A download speed of at least 25.0 Mbps per stream is recommended to receive Ultra HD (defined as a resolution of 1080p or higher) and HDR content. You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges. U.S. WEED CHANNEL makes no representations or warranties about the quality of your watching experience on your display. The time it takes to begin watching U.S. WEED CHANNEL content show will vary based on a number of factors, including your location, available bandwidth at the time, the U.S. WEED CHANNEL content you have selected and the configuration of your U.S. WEED CHANNEL ready device.
U.S. WEED CHANNEL software is developed by, or for use by, U.S. WEED CHANNEL and is designed to enable streaming and viewing of content from U.S. WEED CHANNEL through U.S. WEED CHANNEL ready devices. This software may vary by device and medium, and functionalities may also differ between devices. BY USING OUR SERVICE, YOU ACKNOWLEDGE AND AGREE TO THE END USER LICENSE AGREEMENT AND TO RECEIVE, WITHOUT FURTHER NOTICE OR PROMPTING, UPDATED VERSIONS OF THE U.S. WEED CHANNEL AND RELATED THIRD-PARTY SOFTWARE. IF YOU DO NOT ACCEPT THE FOREGOING TERMS, DO NOT USE OUR SERVICE. WE DO NOT TAKE RESPONSIBILITY OR OTHERWISE WARRANT THE PERFORMANCE OF THESE DEVICES, INCLUDING THE CONTINUING COMPATIBILITY OF THE DEVICE WITH OUR SERVICE. By using our service, you agree to look solely to the entity that manufactured and/or sold you the device for any issues related to the device and its compatibility with the U.S. WEED CHANNEL service. If your U.S. WEED CHANNEL ready device is sold, lost or stolen, please deactivate the U.S. WEED CHANNEL ready device. If you fail to log out or deactivate your device, subsequent users may access the U.S. WEED CHANNEL service through your account and may be able to access certain parts of your account information. To deactivate a device, follow instructions on the "Your Account" page of our website.
We may terminate or restrict your use of our service, without compensation or notice if you are, or if we suspect that you are (i) in violation of any of these Terms of Use or (ii) engaged in illegal or improper use of the service.
Passwords and Account Access
The member who created the U.S. WEED CHANNEL account and whose Payment Method is charged is referred to here as the Account Owner. The Account Owner has access and control over the U.S. WEED CHANNEL account. The Account Owner's control is exercised through use of the Account Owner's password and therefore to maintain exclusive control, the Account Owner should not reveal the password to anyone. In addition, if the Account Owner wishes to prohibit others from contacting U.S. WEED CHANNEL Customer Service and potentially altering the Account Owner's control, the Account Owner should not reveal the Payment Method details (e.g., last four digits of their credit or debit card, or their email address if they use PayPal) associated with their account. You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account.
In order to provide you with ease of access to your account and to help administer the U.S. WEED CHANNEL service, U.S. WEED CHANNEL implements technology that enables us to recognize you as the Account Owner and provide you with direct access to your account without requiring you to retype any password or other user identification when you revisit the U.S. WEED CHANNEL service, which includes accessing via U.S. WEED CHANNEL ready devices or website.
You should be mindful of any communication requesting that you submit credit card or other account information. Providing your information in response to these types of communications can result in identity theft. Always access your sensitive account information by going directly to the U.S. WEED CHANNEL website and not through a hyperlink in an email or any other electronic communication, even if it looks official. U.S. WEED CHANNEL reserves the right to place any account on hold anytime with or without notification to the member in order to protect itself and its partners from what it believes to be fraudulent activity. U.S. WEED CHANNEL is not obligated to credit or discount a membership for holds placed on the account by either a representative of U.S. WEED CHANNEL or by the automated processes of U.S. WEED CHANNEL.
Disclaimers of Warranties and Limitations on Liability
THE U.S. WEED CHANNEL SERVICE AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE U.S. WEED CHANNEL SERVICE, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. U.S. WEED CHANNEL DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE U.S. WEED CHANNEL SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. U.S. WEED CHANNEL SPECIFICALLY DISCLAIMS LIABILITY FOR THE USE OF APPLICATIONS, U.S. WEED CHANNEL READY DEVICES, AND U.S. WEED CHANNEL SOFTWARE (INCLUDING THEIR CONTINUING COMPATIBILITY WITH OUR SERVICE).
TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, IN NO EVENT SHALL U.S. WEED CHANNEL, OR ITS SUBSIDIARIES OR ANY OF THEIR SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES OR LICENSORS BE LIABLE (JOINTLY OR SEVERALLY) TO YOU FOR PERSONAL INJURY OR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. THEREFORE, SOME OF THE ABOVE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.
NOTHING IN THESE TERMS OF USE SHALL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
Gifts and Promotions. Gift cards for the U.S. WEED CHANNEL service may be available for purchase at third-party retail outlets and websites, which can be redeemed on our website at www.USWEEDCHANNEL.com. The purchase and redemption of gift cards are subject to the gift terms. From time to time, other types of promotional codes may be available, including those provided as part of a third party promotion. Promotional codes may be redeemed as described in the specifics of the promotion. Gift cards and promotional codes can only be used once, cannot be redeemed for cash, and may be combined with other offers, including a free trial, subject to certain restrictions as determined by U.S. WEED CHANNEL in its sole discretion. If you received a promotional code through an offer by a third party, additional conditions may apply.
Intellectual Property
Copyright. The U.S. WEED CHANNEL service, including all content provided on the U.S. WEED CHANNEL service, is protected by copyright, trade secret or other intellectual property laws and treaties.
Service marks. U.S. WEED CHANNEL Logo is a registered Service mark of USWC Media, LLC.
Word marks. U.S. WEED CHANNEL Name is a registered Word mark of USWC Media, LLC.
Patents. U.S. WEED CHANNEL has no patents that apply to our service.
Claims of Copyright Infringement.
If you believe your work has been reproduced or distributed in a way that constitutes a copyright infringement or are aware of any infringing material available through the U.S. WEED CHANNEL service, please notify us at [email protected] immediately.
Governing Law. Terms of Use shall be governed by and construed in accordance with the laws of the state of Delaware, U.S.A. without regard to conflict of laws provisions. These terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your state of residence.
Applications.
You may encounter third-party applications (including, without limitation, websites, widgets, software, or other software utilities) ("Application(s)") that interact with the U.S. WEED CHANNEL service. These Applications may import data related to your U.S. WEED CHANNEL account and activity and otherwise gather data from you. These Applications are provided solely as a convenience to you, and U.S. WEED CHANNEL is not responsible for such Applications. SUCH APPLICATIONS ARE OWNED OR OPERATED BY THIRD PARTIES THAT ARE NOT RELATED TO WITH OR SPONSORED BY U.S. WEED CHANNEL AND MAY NOT BE AUTHORIZED FOR USE WITH OUR SERVICE IN ALL COUNTRIES. USE OF AN APPLICATION IS AT YOUR OWN OPTION AND RISK.
Use of Information Submitted.
U.S. WEED CHANNEL is free to use any comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication you may send to us ("Feedback"), including responses to questionnaires or through postings to the U.S. WEED CHANNEL service, including the U.S. WEED CHANNEL website and user interfaces, worldwide and in perpetuity without further compensation, acknowledgement or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and creating, modifying or improving the U.S. WEED CHANNEL service. In addition, you agree not to enforce any "moral rights" in and to the Feedback, to the extent permitted by applicable law. Please note U.S. WEED CHANNEL does not accept unsolicited materials or ideas for U.S. WEED CHANNEL content, and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to U.S. WEED CHANNEL. Should you send any unsolicited materials or ideas, you do so with the understanding that no additional consideration of any sort will be provided to you, and you are waiving any claim against U.S. WEED CHANNEL and its affiliates regarding the use of such materials and ideas, even if material or an idea is used that is substantially similar to the material or idea you sent.
Customer Support.
To find more information about our service and its features, or if you need assistance with your account, please visit U.S. WEED CHANNEL (www.USWEEDCHANNEL.com). In certain instances, Customer Service may best be able to assist you by using a remote access support tool through which we have full access to your computer. If you do not want us to have this access, you should not consent to support through the remote access tool, and we will assist you through other means. In the event of any conflict between these Terms of Use and information provided by Customer Support or other portions of our website, these Terms of Use will control.
Dispute Agreement
If you are a U.S. WEED CHANNEL end-user in the United States (including its possessions and territories), you agree and understand that you hereby waive any and all rights to legal disputes for any cause and of any nature against U.S. WEED CHANNEL, The U.S. WEED CHANNEL Service, USWC Media, LLC., any of its members, associates, and employees.
YOU FURTHER AGREE THAT ANY CLAIMS MADE WILL BE ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and U.S. WEED CHANNEL agree otherwise, the arbitrator may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
Survival. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

Welcome to U.S. WEED CHANNEL!
Introduction
Thank you for using the U.S. WEED CHANNEL platform and the products, services and features we make available to you as part of the platform (collectively, the “Service”).
Our Service
The Service allows you to discover, watch and share videos and other content, provides a forum for people to connect, inform, and inspire others across the globe, and acts as a distribution platform for original content creators and advertisers large and small.
Your Service Provider
The entity providing the Service is USWC Media, LLC., a company operating under the laws of Delaware, located at 651 North Broad St. Suite 206, Middletown, DE 19709 (referred to as “U.S. WEED CHANNEL”, “we”, “us”, or “our”). References to U.S. WEED CHANNEL’s “Affiliates” in these terms means the other companies within the zUSWC Media, LLC. corporate group (now or in the future).
Applicable Terms
Your use of the Service is subject to these terms, the U.S. WEED CHANNEL Community Guidelines and the Policy, Safety and Copyright Policies which may be updated from time to time (together, this "Agreement"). Your Agreement with us will also include the Advertising on U.S. WEED CHANNEL Policies if you provide advertising or sponsorships to the Service or incorporate paid promotions in your content. Any other links or references provided in these terms are for informational use only and are not part of the Agreement.
Please read this Agreement carefully and make sure you understand it. If you do not understand the Agreement, or do not accept any part of it, then you may not use the Service.
Who may use the Service?
Age Requirements
You must be at least 18 years old to use the Service.
Permission by Parent or Guardian
If you are under 18, you represent that you have your parent or guardian’s permission to use the Service. Please have them read this Agreement with you.
If you are a parent or legal guardian of a user under the age of 18, by allowing your child to use the Service, you are subject to the terms of this Agreement and responsible for your child’s activity on the Service.
Businesses
If you are using the Service on behalf of a company or organization, you represent that you have authority to act on behalf of that entity, and that such entity accepts this Agreement.
Your Use of the Service
Content on the Service
The content on the Service includes videos, audio (for example music and other sounds), graphics, photos, text (such as comments and scripts), branding (including trade names, trademarks, service marks, or logos), interactive features, software, metrics, and other materials whether provided by you, U.S. WEED CHANNEL or a third-party (collectively, "Content”).
Content is the responsibility of the person or entity that provides it to the Service. U.S. WEED CHANNEL is under no obligation to host or serve Content. If you see any Content you believe does not comply with this Agreement, including by violating the Community Guidelines or the law, you can report it to us.
Accounts and U.S. WEED CHANNEL Channels
You can use parts of the Service, such as browsing and searching for Content, without having an account. However, you do need a registered, and Paid account to use some features. With a Paid account, you may be able to like videos, subscribe to channels, create your own U.S. WEED CHANNEL channel, and more. You can follow these instructions to create a U.S. WEED CHANNEL account.
Participating as a U.S. WEED CHANNEL content creator will give you access to additional features and functions, such as uploading videos, making comments or creating playlists (where available), Free Promotion, and Monetization.
To protect your account, keep your password confidential. You should not reuse your account password on third-party applications. Learn more about keeping your account secure, including what to do if you learn of any unauthorized use of your password or account.
Your Information
Our Privacy Policy explains how we treat your personal data and protect your privacy when you use the Service.
We will process any audio or audiovisual content uploaded by you to the Service in accordance with the U.S. WEED CHANNEL Data Processing Terms, except in cases where you uploaded such content for personal purposes or household activities.
Permissions and Restrictions
You may access and use the Service as made available to you, as long as you comply with this Agreement and applicable law. You may view or listen to Content for your personal, non-commercial use. You may also show U.S. WEED CHANNEL videos through the embeddable U.S. WEED CHANNEL player on your website upon approval by us.
The following restrictions apply to your use of the Service. You are not allowed to:
access, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify or otherwise use any part of the Service or any Content except: (a) as expressly authorized by the Service; or (b) with prior written permission from U.S. WEED CHANNEL and, if applicable, the respective rights holders;
circumvent, disable, fraudulently engage with, or otherwise interfere with any part of the Service (or attempt to do any of these things), including security-related features or features that (a) prevent or restrict the copying or other use of Content or (b) limit the use of the Service or Content;
access the Service using any automated means (such as robots, botnets or scrapers) except (a) in the case of public search engines, in accordance with U.S. WEED CHANNEL’s robots.txt file; or (b) with U.S. WEED CHANNEL’s prior written permission;
collect or harvest any information that might identify a person (for example, usernames or faces), unless permitted by that person or allowed under section (3) above;
use the Service to distribute unsolicited promotional or commercial content or other unwanted or mass solicitations;
cause or encourage any inaccurate measurements of genuine user engagement with the Service, including by paying people or providing them with incentives to increase a video’s views, likes, or dislikes, or to increase a channel’s subscribers, or otherwise manipulate metrics in any manner;
misuse any reporting, flagging, complaint, dispute, or appeals process, including by making groundless, vexatious, or frivolous submissions;
run contests on or through the Service that are not in direct partnership with U.S. WEED CHANNEL.
use the Service to view or listen to Content other than for personal, non-commercial use (for example, you may not publicly screen videos or stream music from the Service); or
use the Service to (a) sell any advertising, sponsorships, or promotions placed on, around, or within the Service or Content, other than those allowed in the Advertising on U.S. WEED CHANNEL policies (such as compliant product placements); or (b) sell advertising, sponsorships, or promotions on any page of any website or application that only contains Content from the Service or where Content from the Service is the primary basis for such sales (for example, selling ads on a webpage where U.S. WEED CHANNEL videos are the main draw for users visiting the webpage).
Reservation
Using the Service does not give you ownership of or rights to any aspect of the Service, including user names or any other Content posted by others or U.S. WEED CHANNEL.
Develop, Improve and Update the Service
U.S. WEED CHANNEL is constantly changing and improving the Service. As part of this continual evolution, we may make modifications or changes (to all or part of the Service) such as adding or removing features and functionalities, offering new digital content or services or discontinuing old ones. We may also need to alter or discontinue the Service, or any part of it, in order to make performance or security improvements, make changes to comply with law, or prevent illegal activities on or abuse of our systems. These changes may affect all users, some users or even an individual user. When the Service requires or includes downloadable software (such as the U.S. WEED CHANNEL Studio application), that software may update automatically on your device once a new version or feature is available, subject to your device settings. If we make material changes that negatively impact your use of the Service, we’ll provide you with reasonable advance notice, except in urgent situations such as preventing abuse, responding to legal requirements, or addressing security and operability issues. We’ll also provide you with an opportunity to export your content from your Account, subject to applicable law and policies.
Your Video and Music Content and Conduct
Uploading Content
If you are a U.S. WEED CHANNEL creator, you may be able to upload Content to the Service. You may use your Content to promote your business or artistic enterprise. If you choose to upload Content, you must not submit to the Service any Content that does not comply with this Agreement (including the U.S. WEED CHANNEL Community Guidelines) or the law. For example, the Content you submit must not include third-party intellectual property (such as copyrighted material) unless you have permission from that party or are otherwise legally entitled to do so. You are legally responsible for the Content you submit to the Service. We may use automated systems that analyze your Content to help detect infringement and abuse, such as spam, malware, and illegal content.
Rights you Grant
You retain ownership rights in your Content. However, we do require you to grant certain rights to U.S. WEED CHANNEL and other users of the Service, as described below.
License to U.S. WEED CHANNEL
By providing Content to the Service, you grant to U.S. WEED CHANNEL a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use that Content (including to reproduce, distribute, prepare derivative works, display and perform it) in connection with the Service and U.S. WEED CHANNEL’s (and its successors' and Affiliates') business, including for the purpose of promoting and redistributing part or all of the Service.
License to Other Users
You also grant each other user of the Service a worldwide, non-exclusive, royalty-free license to access your Content through the Service, and to use that Content, including to reproduce, distribute, prepare derivative works, display, and perform it, only as enabled by a feature of the Service (such as video playback or embeds). For clarity, this license does not grant any rights or permissions for a user to make use of your Content independent of the Service.
Duration of License
The licenses granted by you continue for a commercially reasonable period of time after you remove or delete your Content from the Service. You understand and agree, however, that U.S. WEED CHANNEL may retain, but not display, distribute, or perform, server copies of your videos that have been removed or deleted.
Right to Monetize
You grant to U.S. WEED CHANNEL the right to monetize your Content on the Service (and such monetization may include displaying ads on or within Content or charging users a fee for access).
This Agreement entitles you to payment of 50% of profits from Ad-Supported Video On Demand, Pay-Per-View, and Rental playback of your content through the Service.
If required by law, U.S. WEED CHANNEL will withhold taxes from such payments.
Removing Your Content
You may remove your Content from the Service at any time.
You must remove your Content if you no longer have the rights required by these terms.
Removal of Content By U.S. WEED CHANNEL
If any of your Content (1) is in breach of this Agreement or (2) may cause harm to U.S. WEED CHANNEL, our users, or third parties, we reserve the right to remove or take down some or all of such Content in our discretion. We may notify you with the reason for our action unless we reasonably believe that to do so: (a) would breach the law or the direction of a legal enforcement authority or would otherwise risk legal liability for U.S. WEED CHANNEL or our Affiliates; (b) would compromise an investigation or the integrity or operation of the Service; or (c) would cause harm to any user, other third party, U.S. WEED CHANNEL or our Affiliates.
Community Guidelines Strikes
U.S. WEED CHANNEL operates a system of “strikes” in respect of Content that violates the U.S. WEED CHANNEL Community Guidelines. Each strike comes with varying restrictions and may result in the permanent removal of your content from U.S. WEED CHANNEL. If you believe that a strike has been issued in error, you may appeal. U.S. WEED CHANNEL has no obligation to reply, or to reinstate your content, or creator account.
If your content has been restricted due to a strike, you must not use another Creator Account to circumvent these restrictions. Violation of this prohibition is a material breach of this Agreement and we reserve the right to terminate your account or your access to all or part of the Service.
Copyright Protection
If you believe your copyright has been infringed on the Service, please send us a notice to; [email protected].
We respond to notices of alleged copyright infringement according to applicable laws. U.S. WEED CHANNEL's policies provide for the termination, in appropriate circumstances, of repeat infringers’ access to the Service.
Account Suspension & Termination
Terminations by You
You may stop using the Service at any time. Content may continue to play on U.S. WEED CHANNEL applications to fulfill any contractual obligations.
Terminations and Suspensions by U.S. WEED CHANNEL
U.S. WEED CHANNEL reserves the right to suspend or terminate your account or your access to all or part of the Service for any reason, or if (a) you materially or repeatedly breach this Agreement; (b) we are required to do so to comply with a legal requirement or a court order; or (c) we reasonably believe that there has been conduct that creates (or could create) liability or harm to any user, other third party, U.S. WEED CHANNEL or our Affiliates.
Notice for Termination or Suspension
We may notify you with the reason for termination or suspension by U.S. WEED CHANNEL unless we reasonably believe that to do so: (a) would violate the law or the direction of a legal enforcement authority; (b) would compromise an investigation; (c) would compromise the integrity, operation or security of the Service; or (d) would cause harm to any user, other third party, U.S. WEED CHANNEL or our Affiliates.
Effect of Account Suspension or Termination
If your account is terminated or your access to the Service is restricted, you may continue using certain aspects of the Service (such as viewing only) without an account, and this Agreement will continue to apply to such use. If you believe that the termination or suspension has been made in error, you can appeal.
About Software in the Service
Downloadable Software
When the Service requires or includes downloadable software (such as the U.S. WEED CHANNEL Studio application), unless that software is governed by additional terms which provide a license, U.S. WEED CHANNEL gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you by U.S. WEED CHANNEL as part of the Service. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Service as provided by U.S. WEED CHANNEL, in the manner permitted by this Agreement. You are not allowed to copy, modify, distribute, sell, or lease any part of the software, or to reverse-engineer or attempt to extract the source code of that software, unless laws prohibit these restrictions or you have U.S. WEED CHANNEL’s written permission.
Open Source
Some software used in our Service may be offered under an open source license that we make available to you. There may be provisions in an open source license that expressly override some of these terms, so please be sure to read those licenses.
Other Legal Terms
Warranty Disclaimer
OTHER THAN AS EXPRESSLY STATED IN THIS AGREEMENT OR AS REQUIRED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND U.S. WEED CHANNEL DOES NOT MAKE ANY SPECIFIC COMMITMENTS OR WARRANTIES ABOUT THE SERVICE. FOR EXAMPLE, WE DON’T MAKE ANY WARRANTIES ABOUT: (A) THE CONTENT PROVIDED THROUGH THE SERVICE; (B) THE SPECIFIC FEATURES OF THE SERVICE, OR ITS ACCURACY, RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS; OR (C) THAT ANY CONTENT YOU SUBMIT WILL BE ACCESSIBLE ON THE SERVICE.
Limitation of Liability
EXCEPT AS REQUIRED BY APPLICABLE LAW, U.S. WEED CHANNEL, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE RESPONSIBLE FOR ANY LOSS OF PROFITS, REVENUES, BUSINESS OPPORTUNITIES, GOODWILL, OR ANTICIPATED SAVINGS; LOSS OR CORRUPTION OF DATA; INDIRECT OR CONSEQUENTIAL LOSS; PUNITIVE DAMAGES CAUSED BY:
ERRORS, MISTAKES, OR INACCURACIES ON THE SERVICE;
PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SERVICE;
ANY UNAUTHORIZED ACCESS TO OR USE OF THE SERVICE;
ANY INTERRUPTION OR CESSATION OF THE SERVICE;
ANY VIRUSES OR MALICIOUS CODE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY;
ANY CONTENT WHETHER SUBMITTED BY A USER OR U.S. WEED CHANNEL, INCLUDING YOUR USE OF CONTENT; AND/OR
THE REMOVAL OR UNAVAILABILITY OF ANY CONTENT.
THIS PROVISION APPLIES TO ANY CLAIM, REGARDLESS OF WHETHER THE CLAIM ASSERTED IS BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
U.S. WEED CHANNEL AND ITS AFFILIATES’ TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF: (A) THE AMOUNT OF REVENUE THAT U.S. WEED CHANNEL HAS PAID TO YOU FROM YOUR USE OF THE SERVICE IN THE 12 MONTHS BEFORE THE DATE OF YOUR NOTICE, IN WRITING TO U.S. WEED CHANNEL, OF THE CLAIM; AND (B) USD $500.
Indemnity
To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless U.S. WEED CHANNEL, its Affiliates, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of this Agreement; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive this Agreement and your use of the Service.

The Service may contain links to third-party websites and online services that are not owned or controlled by U.S. WEED CHANNEL. U.S. WEED CHANNEL has no control over, and assumes no responsibility for, such websites and online services. Be aware when you leave the Service; we suggest you read the terms and privacy policy of each third-party website and online service that you visit.
About this Agreement
Changing this Agreement
We may change this Agreement, for example, (1) to reflect changes to our Service or how we do business - for example, when we add new products or features or remove old ones, (2) for legal, regulatory, or security reasons, or (3) to prevent abuse or harm.
If we materially change this Agreement, we’ll provide you with reasonable advance notice and the opportunity to review the changes, except (1) when we launch a new product or feature, or (2) in urgent situations, such as preventing ongoing abuse or responding to legal requirements. If you don’t agree to the new terms, you should remove any Content you uploaded and stop using the Service.
Continuation of this Agreement
If your use of the Service ends, the following terms of this Agreement will continue to apply to you: “Other Legal Terms”, “About This Agreement”, and the licenses granted by you will continue as described under “Duration of License”.
Severance
If it turns out that a particular term of this Agreement is not enforceable for any reason, this will not affect any other terms.
No Waiver
If you fail to comply with this Agreement and we do not take immediate action, this does not mean that we are giving up any rights that we may have (such as the right to take action in the future).
Interpretation
In these terms, “include” or “including” means “including but not limited to,” and any examples we give are for illustrative purposes.
Governing Law
All claims arising out of or relating to these terms or the Service will be governed by Delaware law, and will be litigated exclusively in the federal or state courts of Delaware, USA. You and U.S. WEED CHANNEL consent to personal jurisdiction in those courts.
Limitation on Legal Action
YOU AND U.S. WEED CHANNEL AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
SMS/Text Messaging Terms of Service
By opting in to receive SMS/text messages from U.S Weed Channel (“we,” “our,” “us”), you agree to the following Terms of Service. These Terms are intended to comply with A2P 10DLC registration and carrier requirements.
1. Program Description

Part III
PRINT ON DEMAND AND PRODUCT PURCHASE TERMS OF SERVICE
PRINT ON DEMAND POLICY
U.S. WEED CHANNEL engages a print-on-demand company, which means that all products are unique and produced only once ordered. This also means that returns and exchanges are not supported if you ordered the wrong size, color, or simply changed your mind.
However, in case of a damaged product or a manufacturing error, U.S. WEED CHANNEL offers a free reprint if you contact us within 30 days of product delivery. Please get in touch with our team and provide a clear photo showing the issue.
Note
Refunds are issued to your U.S. WEED CHANNEL account balance. You can withdraw this amount to transfer it back to the original payment method. However, if your selected billing currency is not United States Dollar (USD), please note that the refund will be returned directly to the original payment source.
If there’s an issue affecting multiple products that use the same design, an additional photo (or video) of all affected items visible in one frame will be required for confirmation purposes.
Please note that U.S. WEED CHANNEL will not be held responsible and will not offer reprints or refunds if the customer ordered the wrong size or color. In case of an unsuccessful delivery, you can opt for either a reprint with an extra charge or a partial refund. For DTG products, there is a tolerance of 0.5" for print placement, meaning that minor variations in the placement of the print will not be considered as defects.
Part IV
USWC Guest Appearance Release & Consent
This Guest Appearance Release & Consent (“Release”) applies to any interview, podcast, television program, livestream, broadcast, recording, event, segment, production, promotional appearance, or other content produced, recorded, distributed, or presented by or on behalf of USWC Media, LLC (“USWC”) for which I register, participate, or otherwise agree to this Release.
By accepting this Release and participating in a USWC production or appearance, I voluntarily agree to the following:
1. Permission to Record
I authorize USWC to photograph, film, livestream, audio record, video record, and otherwise capture my participation and appearance, including my name, voice, image, likeness, biographical information, statements, performance, interview, and other contributions.
2. Rights Granted to USWC
I grant USWC and its affiliates, successors, licensees, distributors, platforms, contractors, and service providers a perpetual, worldwide, royalty-free, transferable, and sublicensable right to use, reproduce, edit, publish, display, perform, distribute, transmit, stream, broadcast, rebroadcast, advertise, promote, license, syndicate, archive, and otherwise exploit recordings of my appearance and participation, in whole or in part.
These rights apply in all media, technologies, platforms, and formats now known or later developed, including television, streaming services, FAST and OTT channels, websites, mobile and television applications, podcasts, radio, social media, digital platforms, advertising, promotional campaigns, trailers, clips, reels, compilations, educational materials, marketing materials, and other USWC programming or content.
3. Editing, Excerpts, Promotion and Localization
USWC may edit, shorten, excerpt, rearrange, reformat, caption, transcribe, translate, dub, enhance, combine, package, repurpose, or otherwise adapt recordings of my appearance for production, accessibility, localization, promotional, distribution, archival, or commercial purposes.
USWC may use automated or artificial-intelligence-assisted tools as part of legitimate production and post-production processes, including transcription, captioning, translation, dubbing, audio or video enhancement, editing, formatting, clipping, and localization.
For clarity, this authorization does not permit USWC to create a synthetic or digital-replica performance depicting me saying or doing something I did not actually say or do unless I separately authorize that use in writing.
USWC will not knowingly use my appearance, statements, voice, or likeness in a manner that materially misrepresents my statements or falsely represents that I personally endorse an unrelated third-party product, service, sponsor, or advertiser.
4. Commercial Use and Monetization
I understand and agree that USWC may commercially exploit and monetize content containing my appearance through advertising, sponsorships, subscriptions, licensing, syndication, distribution agreements, platform revenue, promotional campaigns, affiliate arrangements, or other commercial activities.
Unless USWC and I separately agree otherwise in writing, I am not entitled to compensation, royalties, residuals, revenue sharing, or other payment arising from my appearance or USWC's authorized use of the recording.
The presence of a sponsor, advertiser, affiliate, distributor, or other commercial partner does not by itself constitute an endorsement by me.
5. Ownership of Recordings and Productions
All recordings created by or for USWC, together with USWC-produced programs, episodes, segments, edits, clips, trailers, graphics, thumbnails, promotional materials, compilations, and other productions incorporating my appearance, are owned and controlled by USWC.
To the extent that any copyright, performance right, neighboring right, or other intellectual-property right in my recorded contribution would otherwise vest in me, I assign such rights to USWC to the fullest extent permitted by law.
I retain ownership of intellectual property that I created before my appearance and that was not created specifically for USWC, subject to the permissions granted in this Release.
6. Materials I Provide
If I provide USWC with photographs, logos, trademarks, graphics, music, videos, clips, presentations, documents, websites, social-media content, or other materials in connection with my appearance, I grant USWC a worldwide, royalty-free license to use, reproduce, edit, display, distribute, and promote those materials in connection with my appearance, the applicable USWC production, and promotion or distribution of that content.
I represent that I own those materials or have sufficient authority and permission to allow USWC to use them as described above.
7. No Approval Required
I understand that I will not have the right to inspect or approve the finished program, recording, episode, segment, edits, clips, captions, advertisements, promotional materials, distribution methods, or other authorized uses before publication or distribution.
USWC is not obligated to record, publish, broadcast, distribute, promote, or continue distributing any appearance or content.
8. Release of Claims
To the fullest extent permitted by law, I release USWC and its affiliates, officers, directors, employees, contractors, producers, distributors, licensees, platforms, successors, and assigns from claims arising from uses authorized by this Release, including claims involving rights of publicity, privacy, likeness, voice, copyright, approval of the finished production, or authorized editing and distribution.
Nothing in this Release waives rights or claims that cannot legally be waived.
9. Guest Responsibilities
I understand that my participation is voluntary and that content containing my appearance may be publicly distributed and accessible worldwide.
I agree not to intentionally disclose confidential, proprietary, privileged, defamatory, unlawful, or third-party information that I am not authorized to disclose.
I represent that statements I make and materials I provide are, to the best of my knowledge, lawful for me to provide and do not knowingly infringe the rights of another person or entity.
10. Age and Authority
I represent that I am at least 18 years old and have the legal authority to enter into this Release.
Any participant under 18 must have a separate release approved by a parent or legal guardian before participating.
11. Electronic Acceptance
By checking an agreement box, electronically signing, submitting a registration form that expressly references this Release, or otherwise electronically indicating my acceptance, I confirm that:
I have had the opportunity to read this Release;
I understand and agree to its terms;
I intend my electronic acceptance to constitute my signature and consent; and
this Release applies to the USWC appearance, production, registration, or participation for which I am providing that acceptance.
